Services

Built by Kane provides email marketing, retention marketing, consulting, strategy, design, copywriting, automation setup, and digital product services.

The scope of work for client services will be outlined in a proposal, invoice, agreement, or written communication before work begins.

Any additional work requested outside the agreed scope may incur additional charges.

Payment Terms

All invoices must be paid within the timeframe stated on the invoice unless otherwise agreed in writing.

Built by Kane reserves the right to pause, delay, or withhold services if payments are overdue.

All pricing is listed in AUD unless otherwise stated and may be exclusive of GST where applicable.

No Refunds

Due to the digital and service-based nature of our work, all payments made to Built by Kane are non-refundable once work has commenced.

Work is considered commenced once any strategy, research, planning, copywriting, design, setup, implementation, communication, revisions, or account-related work has begun.

By purchasing a service or digital product, you acknowledge and agree to this policy.

Revisions & Project Timeframes

Clients are responsible for providing timely feedback, approvals, assets, and communication throughout the project.

Once revisions, deliverables, or requested updates have been sent, clients are expected to respond within a reasonable timeframe.

If Built by Kane does not receive a response, required feedback, or requested materials from the client for a period of 3 consecutive months, the project will be considered closed and completed.

After this period:

• Built by Kane is not obligated to continue work on the project

• Additional revisions or requests may require a new quote or project fee

• Access to files, accounts, or deliverables may be removed or archived

Digital Products

Digital products, templates, resources, and downloads purchased from Built by Kane are licensed for individual business use only.

You may not:

• Resell, redistribute, share, sublicense, or reproduce the products

• Claim the products as your own

• Use the products for commercial resale purposes without written permission

Built by Kane retains all intellectual property rights to all digital assets and materials.

Intellectual Property

All strategies, frameworks, templates, copy, designs, systems, and materials created by Built by Kane remain the intellectual property of Built by Kane unless otherwise agreed in writing.

Clients are granted a non-exclusive licence to use delivered assets within their own business only.

Client Responsibilities

Clients are responsible for:

• Providing accurate information

• Providing timely feedback and approvals

• Supplying required assets and platform access

• Maintaining ownership and security of their accounts

Delays caused by missing information, approvals, or access may impact timelines and delivery dates.

Access to Platforms

To provide services, clients may grant Built by Kane access to third party platforms including Klaviyo, Shopify, Meta Ads Manager, analytics tools, and related software.

Built by Kane will take reasonable care when accessing client systems and information. However, we are not responsible for:

• Third party platform outages

• Platform errors or bugs

• Security breaches outside our reasonable control

• Issues caused by changes made by the client or third parties

Clients may revoke access at any time following the completion or cancellation of services.

Results & Earnings Disclaimer

Built by Kane does not promise, guarantee, or warrant specific financial results, revenue growth, or business performance outcomes from any service, strategy, product, or recommendation.

Any revenue figures, case studies, testimonials, or examples shared on this website, social media, emails, proposals, or marketing materials are provided for illustrative purposes only and should not be considered typical or guaranteed results.

Results will vary depending on factors including but not limited to:

• Product quality

• Offer strength

• Pricing

• Website conversion rate

• Traffic quality

• Advertising spend

• Market conditions

• Customer experience

• Consistency of implementation

All business carries financial risk and requires ongoing effort, action, and decision making.

Limitation of Liability

To the maximum extent permitted by law, Built by Kane is not liable for any indirect, incidental, special, or consequential losses including loss of revenue, profits, business opportunities, or data.

Liability is limited to the total amount paid for the relevant service or product.

Confidentiality

Both parties agree to keep confidential any non-public business, marketing, customer, operational, or financial information shared during the course of a project or engagement.

Termination

Built by Kane reserves the right to refuse, pause, or terminate services where necessary, including in cases of:

• Non-payment

• Abusive or inappropriate behaviour

• Breach of these Terms & Conditions

• Failure to provide required access or communication

Changes to These Terms

Built by Kane may update these Terms & Conditions at any time without prior notice. Updated versions will be published on this page.
